Examining the exams

The July month witnessed a huge controversy over NEET (National Eligibility cum Entrance Test)                   paper leak which shook the confidence of students. NEET is widely acknowledged as the most competitive of entrance examinations. This year a total of 22.79 lakh students registered for the exam and 22.05 lakh students appeared for 1.36 lakh medical seats across 823 medical colleges. It is a gateway to undergraduate medical education and an aspirational professional course sought- after by millions of young men and women. Admission to medical course is seen as an opportunity at social mobility. The alleged paper leak and the trauma it caused to the aspirants, therefore, goes beyond words. It also raises serious questions about credibility of the examination system and institutional credibility of the NTA (National Testing Agency).  When a highly competitive examination is compromised the damage is not limited to one test but extends to trust in the entire testing system.

 NEET is a paper-pen exam and inherently vulnerable at many stages such as printing, storage, transport, distribution and handling at the exam centres. Each stage offers an opportunity for fraud, collusion or human error. A breach at any stage can cause widespread panic among students and parents. The impact on young students is more severe. They suspect that fellow competitors may have gained unfair access to questions beforehand, a scenario which creates immense psychological stress, anger and anguish at the same time. Administratively an allegation of leakage causes legal litigation, delay in admissions and erosion of public confidence in governance. The scale of the failure suggests that the system is short on oversight and logistics warranting revamp and putting in place robust security protocols.

Revamp of the system must begin with stronger exam security capable of withstanding organized attempt to breach. Cognoscenti of competitive exams suggest a computer based test (CBT) which largely reduces the risk of physical paper leakage and allows tighter control over question paper delivery. An encrypted question paper, multiple randomized sets make unauthorized access mush harder.  The problem of impersonation can be addressed through biometric authentication and facial recognition to ensure only the right candidate enters the exam hall. Intensive, but not intrusive, supervision along with closed circuit cameras in place will make the exam hall friendlier for honest candidates. 

Besides technological response to the problem administrative measures must be initiated in tandem. Granting constitutional status to NTA on the lines of UPSC is advocated by some as a measure of institutional reform to make it more stable. A stronger whistleblower mechanism to help detect irregularities, faster investigation timelines may further make the institution more transparent, accountable and trustworthy.

At the time of composing this article media reports that Public Examinations (Prevention of Unfair Means) Amendment Bill 2026 otherwise known as Anti-Paper Leak Bill has been introduced in Parliament containing stricter penalties and punishments. It is also reported that an experts committee headed by Nandan Nilekani is being set up to reform the examination system. One can only hope and trust that the committee comes up with implementable recommendations and the Bill becomes law. In a federal polity the success of any measure, however, lies in its implementation. Since education is in the concurrent list it is reasonable to assume unwillingness to implement the law by certain states, a challenge that cannot be wished away. The country needs an examination system that is not merely efficient on paper but trustworthy in practice. Until that happens the law and the processes and protocols remain more like questions and less like answers.

GOOD GOVERNANCE IS A TWO-WAY PROCESS

Good governance is one of the most important foundations of a stable, fair, and successful society. It refers to the proper management of public affairs in a way that is transparent, accountable, responsive, and inclusive. While governments have the primary responsibility of governing, citizens also play a crucial role in making governance effective. Without active citizen participation, even the policies may fail to meet the real needs of the people. Therefore, citizens are not just recipients of government services; they are essential partners in the process of good governance.

One of the most important ways citizens contribute to good governance is through participation in elections. Citizens must exercise caution and prudence in choosing a capable and honest contestant whose credentials for commitment to public service are beyond suspicion. However, mere choosing is not the end of process. Citizens must stay informed about government policies and the performance of the elected representatives. An informed citizen is better equipped to hold the government and its representatives to account and eventually lead to taking wise decisions and results in good governance.

The other dimension of good governance is transparency which enjoins the government to place its actions, decisions and financial transactions in public domain which renders them to public scrutiny. In doing so the government enables the citizens to seek information and ask questions about how resources are used. Citizens strengthen accountability and transparency when they report wrongdoing, criticize public policy, and poor performance. The Right to Information Act 2005, and the Whistle Blowers Protection Act 2014, serve the purpose of ensuring accountability and transparency in governance. Invoking these Acts wisely by the citizens will help reduce misuse of power and corruption and improve service delivery.

There is no gainsaying that citizen participation in decision making makes democracy robust. It builds trust between the public and the state. Governments often make policies that affect education, healthcare, infrastructure and social welfare. Citizens should take part in community meetings, public consultations, social audit and civic organizations to share their views and concerns.   When governments listen to people’s concerns  the policies and programmes become more inclusive, effective and reflect the needs of different groups in society more particularly the women, youth and marginalized communities.

It is equally important that citizens contribute to good governance by obeying laws and respecting public institutions. Civic responsibility includes paying taxes, protecting public property, civic behavior in public places and respecting others rights. Participating in community service through social activism, advocacy of social cause, volunteering in welfare and development programmes and assist local communities to solve local problems such as waste management, poor sanitation and lack of access to education strengthens social cohesion and demonstrates the social consciousness of citizens. It also shows that governance is a shared responsibility.

Good governance is best achieved through a cooperative and collaborative process between the state and citizen. It is a two-way process in which citizens play vital role in choosing honest and capable leaders, stay informed, seek accountability of people in power and conversely fulfill their role as law abiding and socially conscious citizens.

కోర్టులు భయం నీడలో పనిచేస్తున్నాయా..!

వ్యక్తుల ప్రాథమిక హక్కులకి కోర్టులు అత్యంత ప్రాధాన్యత ఇవ్వాల్సి ఉంటుంది. రాజ్యాంగంలోని ఆర్టికల్‌‌‌‌‌‌‌‌ 32 ప్రకారం ప్రాథమిక హక్కులకు రక్షణ కల్పించాల్సిన బాధ్యత సుప్రీం కోర్టు మీద ఉంది.ప్రాథమిక హక్కులకు భంగం వాటిల్లినప్పుడు కోర్టులు తప్పక జోక్యం చేసుకోవాల్సి ఉంటుంది. రమశ్ థాపర్ వర్సెస్ స్టేట్‌‌‌‌‌‌‌‌ ఆఫ్ మద్రాస్ కేసులో ఈ విషయాన్నే సుప్రీంకోర్టు 1950లో చెప్పింది.

రాజ్యాంగంలోని ఆర్టికల్‌‌‌‌‌‌‌‌ 141 ప్రకారం సుప్రీంకోర్టు ప్రకటించిన న్యాయ సూత్రాలను సుప్రీంకోర్టు పాటించాల్సి ఉంటుంది. ఈ తీర్పు ప్రకారం ప్రాథమిక హక్కులకి సుప్రీంకోర్టు రక్షకుడిగా, హామీదారుగా వ్యవహరించాల్సి ఉంటుంది. ఈ చారిత్రక పాత్రను కోర్టు విస్మరించడం అంటే కోర్టు తన రాజ్యాంగపరమైన బాధ్యత నుంచి తప్పుకుంటుందని భావించాల్సి ఉంటుంది. ఆర్టికల్ 32ని రాజ్యాంగ ఆత్మగా అంబేద్కర్ అభివర్ణించారు.

ప్రాథమిక హక్కుల ఉల్లంఘనలు ఘోరంగా జరిగినప్పుడు కోర్టులు తమకు తాముగా (సుమోటో) జోక్యం చేసుకోవాల్సి ఉంటుంది. కార్య నిర్వాహక అతిక్రమణలకు రక్షణ కల్పించాల్సింది కోర్టులే. న్యాయవ్యవస్థే ఏకైక రక్షణం. ‘ మా సమయాన్ని వృథా చేయకండి. వీడియోలు చూసే సమయం మాకు లేదు’ అని ప్రధాన న్యాయమూర్తి అనడం తీవ్రమైన ఆందోళనను కలగజేస్తుంది.

హైకోర్టులను ఆశ్రయించమని సూచిస్తూ ఉత్తర్వులు జారీ చేస్తుంటారు. అవసరమైన సందర్భాలలో జోక్యం చేసుకునే బాధ్యత నుంచి తప్పించుకుంటున్నట్టు అనిపిస్తుంది. సుప్రీంకోర్టులో పనిభారం ఎక్కువగా ఉంది. ఆ మాటకొస్తే ప్రతి హైకోర్టు పనిభారంతోనే ఉన్నాయి. పౌరులు ప్రాథమిక హక్కుల రక్షణ కోసం కోర్టులను ఆశ్రయిస్తున్నప్పుడు ఈ విధంగా హైకోర్టులకు వెళ్లమని ఆదేశించడం ఎంతవరకు సబబో అర్థంకాదు. ఇది అన్ని కేసులలో జరగడం లేదు.

2011 రామ్ లీలా మైదాన్ లో పోలీసుల దాడిని సుమోటోగా..

బాబా రామ్‌‌‌‌‌‌‌‌దేవ్‌‌‌‌‌‌‌‌ బాబా పిలుపు మేరకు నల్లధనానికి వ్యతిరేకంగా జూన్ 5, 2011న నిరసన ఢిల్లీలో జరిగింది. ఢిల్లీలోని రామ్‌‌‌‌‌‌‌‌లీలా మైదాన్‌‌‌‌‌‌‌‌లో గుమిగూడిన, నిద్రిస్తున్న నిరసనకారులపై ఢిల్లీ పోలీసులు అర్ధరాత్రి హింసాత్మక దాడికి పాల్పడ్డారు. తెల్లవారి వివిధ పత్రికల్లో వచ్చిన నివేదికలను ఆధారం చేసుకుని సుప్రీంకోర్టు ఈ దాడిని సుమోటోగా స్వీకరించింది. ఇన్‌‌‌‌‌‌‌‌రీ వర్సెస్ రామ్‌‌‌‌‌‌‌‌లీలా మైదాన్ సంఘటనగా ఈ కేసు ప్రాచుర్యం పొందింది.
పోలీసుల హింసాత్మక చర్యలకు వ్యతిరేకంగా జరిగిన అత్యంత బలమైన న్యాయపరమైన జోక్యం కేసులలో ఇది ఒకటిగా నిలిచింది.

పోలీసుల అధికార దుర్వినియోగాన్ని, పౌరుల స్వేచ్ఛను హరించడాన్ని కోర్టు ఖండించింది. ఈ ఖండనకే పరిమితం కాకుండా ఇటుకలు విసరడం, లాఠీచార్జి, టియర్ గ్యాస్‌‌‌‌‌‌‌‌ మితిమీరి వాడిన పోలీసు సిబ్బందిపై శాఖాపరమైన చర్యలు, క్రిమినల్ చర్యలు తీసుకోవాలని ఆదేశించింది. ఆ దాడిలో గాయపడినవారికి ముఖ్యంగా చనిపోయినవారికి మధ్యంతర పరిహారం చెల్లించాలని ఆదేశించింది. ఈ తీర్పు వచ్చి 15 సంవత్సరాలు గడిచాయి. న్యాయ వ్యవస్థలో ఆ వేగం పెరగాల్సిందిపోయి కొరవడినట్లు అనిపిస్తుంది. కానీ, అవినీతి గురించి న్యాయవ్యవస్థపై వచ్చిన పాఠ్యాంశం విషయంలో మాత్రం కోర్టు తీవ్రంగా స్పందించింది. తనకు తాను గా కేసు నమోదు చేసి విచారించి ఉత్తర్వులు జారీ చేసింది.
న్యాయవ్యవస్థపై విద్యార్థులకు తప్పుడు అభిప్రాయం ఏర్పడవచ్చన్న ఒకే ఒక్క కారణంతో దాన్ని తమకు తాముగా స్వీకరించింది సుప్రీంకోర్టు. గత ఐదు సంవత్సరాలుగా జరిగిన నిరసనలను ప్రభుత్వం అణచివేయడం పట్ల న్యాయస్థానాల వైఖరి చాలా నిరాశాజనకంగా ఉంది.

2019లో సీఏఏ నిరసనల సమయంలో విద్యార్థులను కొట్టడానికి పోలీసులు విశ్వవిద్యాలయంలోకి ప్రవేశించారన్న ఆరోపణలు వచ్చాయి. అక్కడి గ్రంథాలయంలోకి పోలీసులు ప్రవేశించి కొడుతున్న దృశ్యాలు వెలుగులోకి వచ్చాయి. అవి ఢిల్లీ హైకోర్టు దాకా వెళ్లాయి. కానీ ఇంతవరకు కంటిచూపు కోల్పోయిన విద్యార్థి పిటిషన్‌‌‌‌‌‌‌‌ ఇంకా ఢిల్లీ హైకోర్టులో పెండింగ్‌‌‌‌‌‌‌‌లో ఉంది.

కోర్టుల ఉపేక్ష ధోరణి

పోలీసుల దాడుల విషయంలో కోర్టులు ఉపేక్ష ధోరణిలో ప్రవర్తిస్తున్నాయి. నిరాహార దీక్ష చేస్తున్న వాంగ్‌‌‌‌‌‌‌‌చుక్‌‌‌‌‌‌‌‌ని బలవంతంగా ప్రభుత్వ ఆసుపత్రికి తరలించినప్పుడు కోర్టు వెంటనే జోక్యం చేసుకోలేదు. తనకు నచ్చిన హాస్పిటల్‌‌‌‌‌‌‌‌కి బదిలీ చేయాలన్న అభ్యర్థనను సరైన రీతిలో కోర్టులు పట్టించుకోలేదు. ఇట్లా చెప్పుకుంటూపోతే ఎన్నో ఉదాహరణలని చెప్పవచ్చు. న్యాయ సేవాధికార సంస్థల చట్టం అమల్లోకి వచ్చిన తరువాత దేశంలో ఎక్కడో ఒకచోట సమావేశాలు జరుగుతూనే ఉంటాయి.
వాటికి న్యాయమూర్తులు వెళుతూ ఉంటారు. వారాంతాల్లో ఉపన్యాసాలు ఇవ్వడంలోని శ్రద్ధ ఇటువంటి రాజ్యాంగపరమైన విధులు నిర్వర్తించడానికి కూడా ఉపయోగిస్తే బాగుంటుందేమో. విద్యార్థులకు సంబంధించిన కేసులో ప్రధాన న్యాయమూర్తి ప్రదర్శించిన ధోరణి చాలా విమర్శలకి గురవుతుంది. గత కాలపు న్యాయమూర్తులతో పోలిస్తే కొంత విచారం కలుగుతుంది.

భయంతో…

ఈ మధ్య ప్రముఖ న్యాయవాది దుష్యంత్‌‌‌‌‌‌‌‌ దవేని ‘వైర్’ కోసం కరణ్ థాపర్‌‌‌‌‌‌‌‌ ‌‌‌‌‌‌‌‌ ఇంటర్వ్యూ చేశారు. ఇది రెండు చేదు నిజాలను తెలియజేసింది. దవే ప్రకారం దేశవ్యాప్తంగా న్యాయమూర్తులు కార్యనిర్వాహకవర్గం పట్ల భయంతో పనిచేస్తున్నట్టు అనిపిస్తుంది. ఉన్నత స్థాయి నుంచి ధైర్యవంతమైన నాయకత్వం లేకపోవడంతో న్యాయవ్యవస్థ స్వాతంత్ర్యం దెబ్బతింటుంది. ప్రత్యేకంగా ప్రభుత్వ చర్యలకు వ్యతిరేకంగా జోక్యం చేసుకునే తన విధి నుంచి సుప్రీంకోర్టు వెనుకాడినప్పుడు అది కార్యనిర్వాహకవర్గానికి మరింత ధైర్యానిస్తుంది.
పౌరులను రక్షించడానికి అవసరమైన రక్షణ కవచం లేకుండా దిగువ కోర్టులకు వదిలేస్తుంది. హైకోర్టు న్యాయమూర్తులను అనవసర బదిలీ చేయడం, దిగువ కోర్టు న్యాయమూర్తులకు పదోన్నతులను నిరాకరించడం లాంటి సంఘటనలు కొందరిలో నిరుత్సాహాన్ని కలుగజేస్తాయి. ఈ పరిస్థితులలో అత్యున్నత కోర్టు ఉపేక్ష ధోరణి, కార్యనిర్వాహక వ్యవస్థ అతిక్రమణలు, ప్రాథమిక హక్కులను రక్షించడంలో పై కోర్టులు తమ బాధ్యతని విస్మరించినప్పుడు కింది కోర్టులు అదేవిధంగా ఉపేక్షించే ధోరణిలోనే ఉంటాయి.

ప్రతీకాత్మక స్ఫూర్తి కోసం

జస్టిస్‌‌‌‌‌‌‌‌ హెచ్‌‌‌‌‌‌‌‌ఆర్‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌ ఖన్నాని జనవరి 1973లో భారత ప్రధాన న్యాయమూర్తిగా ఎంపిక చేయాలి. కానీ చేయలేదు. దానికి ప్రధాన కారణం అత్యవసర పరిస్థితి కాలంలో సుప్రీంకోర్టు వెలువరించిన పడియమ్‌‌‌‌‌‌‌‌ జబల్‌‌‌‌‌‌‌‌పూర్‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌ వర్సెస్‌‌‌‌‌‌‌‌ శివకాంత్‌‌‌‌‌‌‌‌ శుక్లా (1976) కేసులో ఆయన విభిన్న తీర్పుని (డిస్సెంటింగ్‌‌‌‌‌‌‌‌) ప్రకటించారు. ఎమర్జెన్సీ కాలంలో పౌరులకి ప్రాథమిక హక్కులు ఉండవని నలుగురు న్యాయమూర్తులు ప్రకటించగా, జస్టిస్ హెచ్ఆర్‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌ ఖన్నా ఒక్కరే దానికి పూర్తి వ్యతిరేకంగా చారిత్రాత్మక తీర్పుని ప్రకటించారు.

పౌరుడి జీవించే హక్కుని, వ్యక్తిగత స్వేచ్ఛను ఎమర్జెన్సీ పేరు చెప్పి హరించలేమని ఆయన తన డిస్సెంట్‌‌‌‌‌‌‌‌ తీర్పులో స్పష్టం చేశారు. ఈ నిర్ణయం వల్ల వచ్చే పరిణామం ఆయనకు తెలుసు. తాను ఇచ్చే ఆ తీర్పువల్ల తనకు రావాల్సిన భారత ప్రధాన న్యాయమూర్తి పదవిని కోల్పోతానన్నా విషయాన్ని ఆయన తన సోదరితో చెప్పాడు. అదే జరిగింది. దానికి నిరసనగా జస్టిస్‌‌‌‌‌‌‌‌ ఖన్నా అదేరోజు తన న్యాయమూర్తి పదవికి రాజీనామా చేశారు. 44వ రాజ్యాంగ సవరణ ద్వారా ఎమర్జెన్సీ సమయంలో కూడా ఆర్టికల్‌‌‌‌‌‌‌‌ 20, 21 లను రద్దు చేయడానికి వీలు లేకుండా మార్పులను తీసుకునివచ్చారు.

‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌న్యాయమూర్తులకు నిజాయితీ, ధైర్యం అవసరం

2017లో పుట్టస్వామి (రైట్ టు ప్రైవసీ) తీర్పులో సుప్రీంకోర్టు ఇచ్చిన మెజారిటీ తీర్పుని తప్పుబడుతూ జస్టిస్‌‌‌‌‌‌‌‌ ఖన్నా ఇచ్చిన విభిన్న తీర్పే సరైన, రాజ్యాంగబద్ధమైన తీర్పు అని అధికారికంగా ప్రకటించి ఆయనను గౌరవించింది. అంతకుముందే సుప్రీంకోర్టులోని రెండో కోర్టులోని గోడకి ఆయన చిత్రపటాన్ని ఏర్పాటుచేసి సుప్రీంకోర్టు గౌరవించింది. ఇప్పుడు ఆయన చిత్రపటాన్ని ప్రతి కోర్టు హాలులో ఉంచితే బాగుండునని అనిపిస్తుంది. రాజ్యాంగాన్ని కాపాడటానికి అవసరమైన ధైర్యం, నిజాయితీ నేటి న్యాయమూర్తులకు ఇది నిరంతరం గుర్తు చేస్తుంది.

దేశంలో ఇప్పడున్న పరిస్థితి నేపథ్యంలో జులై 28, 2026న జరగాల్సిన జస్టిస్‌‌‌‌‌‌‌‌ హెచ్ఆర్‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌ ఖన్నా మూడవ స్మారక ఉపన్యాసం వాయిదా పడింది. ‘ఫిరాయింపుల నుంచి విలీనాల వరకూ 10వ షెడ్యూలుని రద్దు చేయాల్సిన అవసరం’ అన్న అంశం మీద జరగాల్సిన సమావేశం అది. ఈ కార్యక్రమానికి ముఖ్య అతిథి భారత ప్రధాన న్యాయమూర్తి జస్టిస్ సూర్యకాంత్. ఆయన చేసిన కొన్ని వ్యాఖ్యల కారణంగా వాయిదా వేశారని తెలుస్తోంది.

పౌరుల హక్కు

శాంతియుత ప్రదర్శనల ద్వారా తమ అసమ్మతిని వ్యక్తం చేసే హక్కు ప్రతి పౌరుడికి ఉంది. వారిని హింసాత్మకంగా అణచివేయడం సరైంది మాత్రం కాదు. పోలీసుల చర్యల పట్ల కోర్టులు తక్షణం స్పందించాలి. ఆలస్యంగా స్పందిస్తే కోర్టుల పట్ల విశ్వసనీయత తగ్గిపోతుంది

లక్ష్యం కన్నా బాధ్యత ముఖ్యం

లక్ష్యం అనేది మనం చేరుకోవాలనుకునే గమ్యం.
బాధ్యత అనేది ఆ గమ్యాన్ని చేరుకునే ప్రయాణంలో నిజాయితీ, కర్తవ్యం, విలువలను కాపాడుకుంటూ ముందుకు సాగడం.
లక్ష్యం ఉంటే విజయం సాధించవచ్చు. కానీ బాధ్యతతో పనిచేస్తే విజయంతో పాటు నమ్మకం, గౌరవం, మంచి పేరు కూడా సంపాదించవచ్చు.
